Workmen Compensation

An employer is liable to pay compensation in accordance with the provisions of this Act if a workman under its employment is accidentally injured in the course of employment. “Workman” is a defined term under this Act. This Act imposes other duties on the employer including compulsory insurance. Certain categories of employers are such as companies fully owned by the government, international shipping lines, international oil companies, banks and finance companies and employers of all persons employed otherwise than by way of manual labour are exempted from the requirement to take up compulsory insurance.

Real Estate Law

Real estate is a legal term that encompasses land along with improvements to the land, such as buildings, fences, wells and other site improvements that are fixed in location—immovable. Real estate law is the body of regulations and legal codes which pertain to such matters under a particular and include things such as commercial and residential real property transactions. Real estate is often considered synonymous with real property (sometimes called realty), in contrast with personal property (sometimes called chattel or personalty under chattel law or personal property law).

Probate

'Probate' is a term commonly used when talking about applying for the right to deal with a deceased person's affairs. It's sometimes called 'administering the estate'.

Personal Injury Case

"Personal injury" cases are legal disputes that arise when one person suffers harm from an accident or injury, and someone else might be legally responsible for that harm. A personal injury case can become formalized through civil court proceedings that seek to find others legally at fault through a court judgment or, as is much more common, such disputes may be resolved through informal settlement before any lawsuit is filed:

  • Formal "Lawsuit": Unlike criminal cases, which are initiated by the government, a formal personal injury case typically starts when a private individual (the "plaintiff") files a civil "complaint" against another person, business, corporation, or government agency (the "defendant"), alleging that they acted carelessly or irresponsibly in connection with an accident or injury that caused harm. This action is known as "filing a lawsuit".
  • Informal Settlement: In reality, most disputes over fault for an accident or injury are resolved through informal early settlement, usually among those personally involved in the dispute, their insurers, and attorneys representing both sides. A settlement commonly takes the form of negotiation, followed by a written agreement in which both sides forgo any further action (such as a lawsuit), choosing instead to resolve the matter through payment of an agreeable amount of money.

Litigation

Litigation is generally understood to comprise the provision of advice and representation, whether by way of negotiations, civil proceedings, alternative dispute resolution processes, mediation or arbitration proceedings, in all matters relating to dispute resolution from a vast range of issues from commercial contracts, purchase and sale of assets, equipment or other lease agreements, banking and financing litigation including secured/unsecured enforcement and recovery, multi-party creditor disputes, asset recovery and tracing, and disputes regarding various security, financing or trade instruments such as guarantees, bonds and letters of credit and other such matters. We have been involved in a wide variety of suits in the Court of Appeal, High Court and the Subordinate Courts.

Land Law

Land law is the form of law that deals with the rights to use, alienate, or exclude others from land. In many jurisdictions, these species of property are referred to as real estate or real property, as distinct from personal property. Land use agreements, including renting, are an important intersection of property and contract law. Encumbrance on the land rights of one, such as an easement, may constitute the land rights of another. Mineral rights and water rights are closely linked, and often interrelated concepts.

Insurance Law

We tapped into all aspects of Insurance law and agreements and work without clients to ensure that their insurance needs are met and covered from a legal perspective. We represent our clients in industry related areas, corporate insurance coverage, commercial insurance, individual personal insurance coverage, inclusive of advises and arbitration in seeking of coverage and the rights and liabilities exposure.

Insolvancy Law

This is generally understood to relate to acting for and advising lenders, other creditors, debtors, trustees in bankruptcy, receivers and other participants in corporate insolvencies and debt enforcement, collection and recovery, and typically involves bankruptcy, receivership or similar court-supervised insolvency proceedings or private enforcement remedies. Our firm has conducted both bankruptcy proceedings as well as defended actions for bankruptcy. We also have vast experiences in matters pertaining to Winding-up of Companies and Judicial Management where we work closely with our dedicated team of associated accountants.

Family Law

Family law or domestic relations is an area of the law that deals with family-related issues including, but not limited to marriage, civil unions, divorce, spousal abuse, child custody and visitation, property, alimony, and child support awards, as well as child abuse issues, and adoption. We advise and act for clients in matters pertaining to maintenance and protection of spouses and children, divorce, nullity and separation, custody of children, adoption of children, distribution of matrimonial assets wills/Intestacy and cross-border matrimonial disputes.

Employment Law

In employment litigation and disputes, we have represented numerous management clients, corporate and individuals addressing their rights and liability and offering advises and negotiating for their executive rights and compensation both in Singapore Courts and through Arbitration. We handled claims such as wrongful dismissal, non-competition and trade secrets, retirement compensation, employee benefits, wages issues and defamation.

We have successfully claimed for injunction and damages in employment cases, defended our clients in their wages claim pursuant to the Employment Act and their employment contract and favorable rulings in trade secrets agreements. We also work with our clients in their compliance with laws and regulations and assists in investigatory proceedings

Criminal Law

Criminal Law governs crimes that are prohibited by statute, prosecuted and punished by the government. We have represented accused persons by way of either written representations to the relevant authorities in criminal cases or if necessary, by making representations in the Courts. We have also been acting for clients in a wide range of cases involving failure of professional duty, violations of contract, copyright Infringement offences, immigration offences, traffic offences, offences against persons and property, Commercial Affairs Department offences such as criminal breach of trust and forgery, falsification of accounts, cheating and fraud, thefts, drug offences and outrage of modesty.

Corporate Law

Corporate law is a part of a broader companies law (or law of business associations). Other types of business associations can include partnerships (like most law firms), or trusts (like a pension fund) or companies limited by guarantee (like some universities or charities). Corporate law is about big business, which has separate legal personality, with limited liability or unlimited liability for its members or shareholders, who buy and sell their stocks depending on the performance of the board of directors. It deals with the firms that are incorporated or registered under the corporate or company law of a sovereign state or their subnational states.

Contract Law

In law, a contract is an agreement between two or more parties which, if it contains the elements of a valid legal agreement, is enforceable by law or bybinding arbitration. A legally enforceable contract is an exchange of promises with specific legal remedies for breach. These can include compensatory remedy, whereby the defaulting party is required to pay monies that would otherwise have been exchanged were the contract honoured, or an Equitable remedy such as Specific Performance, in which the person who entered into the contract is required to carry out the specific action they have reneged upon.

Company Law

Singapore Companies Amendment Act 2005 came into effect on 30 January 2006. The Companies Act (Cap 50) was amended to adopt several changes recommended in the final report of the Company Legislation and Regulatory Framework Committee (CLRFC’) that was published on 22 October 2002. The key amendments arising from the Amendment Act include:

  • The abolition of the concepts of ‘par value’ and ‘authorised capital’;
  • Reforming the capital maintenance regime, including:
    • The introduction of an alternative capital reduction process which does not require court sanction;
    • The liberalising of financial assistance restrictions (to allow financial assistance to be provided in additional circumstances);
    • The reform of the share buyback regime;and
    • The enabling of redemption of preference shares;
  • The introduction of the concept of treasury shares (new sections 76H to 76K allow a company to hold re-purchased shares in treasury instead of cancelling them); and
  • Liberalising the amalgamation process for companies (new sections 215A to 215J allow amalgamation of companies, including holding companies and their subsidiaries, without a court order).

Civil Law

Civil law (or civilian law) is a legal system inspired by Roman law, the primary feature of which is that laws are written into a collection, codified, and not common law) determined by judges. Conceptually, it is the group of legal ideas and systems ultimately derived from the Code of Justinian, but heavily overlaid by Germanic, ecclesiastical, feudal, and local practices, as well as doctrinal strains such as natural law, codification, and legislative positivism. Materially, civil law proceeds from abstractions, formulates general principles, and distinguishes substantive rules from procedural rules. It holds legislation as the primary source of law, and the court system is usually inquisitorial, unbound by precedent, and composed of specially trained judicial officers with a limited ability to interpret law.

Business Law

In defending our clients in bankruptcy cases, we take thoroughness to analyse and evaluate such contentious claims. We have successfully filed and succeed in suits against directors, debtors, companies and individuals, both in corporate sector and individually or related third parties. Our scope extends to areas such as pension law, securities, guarantor liability and corporate governance.

Arbitration

In the practice of alternative dispute resolution, Satwant & Associates has provided services to clients from around the globe, providing various avenues for clients to reach consensus grounds. This avenue allows each client to achieve decision faster and is more cost effective. This procedure involves mediation in which an impartial third party, usually, experienced and senior District Judges, or retired Judges, to sit as an Arbitrator/ Mediator to hear the cases of the respective parties and resolve the dispute privately and in an amicable manner. The Attorney role in this case is to act as Settlement Counsel rather than Litigating Counsel. Satwant & Associates have engaged itself in various dispute resolutions involving, naming a few, contract, insurance, fiduciary duties, partnership disputes, bankruptcy and also in multi party disputes involving multi million dollar which has resulted to favorable settlement to clients.
